Welcome to EPFoodies. These Terms & Conditions (“Terms”) govern your use of the website https://www.epfoodies.com (the “Site”), operated by EPFoodies, a project of SC Studios (“we,” “us,” or “our”).
By accessing or using EPFoodies, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site.
1. About EPFoodies
EPFoodies is a community platform for food lovers in the Eastern Panhandle of West Virginia. We maintain a directory of local food trucks, publish restaurant reviews, send a weekly newsletter, and provide tools for food truck owners to share their weekly schedules with the public.
Use of the Site is currently free. We reserve the right to introduce paid features, sponsored listings, or advertising in the future, subject to additional terms where applicable.
2. Eligibility
You must be at least 13 years old to use EPFoodies. If you are between 13 and 18, you should review these Terms with a parent or guardian. By using the Site, you represent that you meet these requirements.
3. Accounts
Some features (such as food truck owner dashboards) require an account. If you create an account, you agree to:
- Provide accurate, current, and complete information
- Keep your password secure and not share it with others
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms or that appear to be used for fraud, harassment, or misrepresentation.
4. Food Truck Owner Listings
If you register as a food truck owner on EPFoodies, you agree that:
- The information you submit (truck name, cuisine, town, phone, Instagram, description, schedule, location details) is accurate and represents a real, legitimate food truck business that you own or are authorized to represent.
- You will not submit misleading, defamatory, or impersonating content.
- Your listing and weekly schedule submissions will be displayed publicly on the Site, including (but not limited to) the food truck directory, individual profile pages, the weekly email newsletter, and social media channels operated by EPFoodies.
- You grant EPFoodies a non-exclusive, royalty-free license to display, reproduce, and distribute your submitted content for the purpose of operating the Site and related community activities.
- We reserve the right to edit, remove, or refuse any listing at our discretion, including for inaccuracy, abuse, or inactivity.
You may request deletion of your listing at any time by contacting moises@epfoodies.com.
5. User Conduct
When using EPFoodies, you agree not to:
- Post or transmit any content that is unlawful, defamatory, harassing, obscene, or infringing on others’ rights
- Impersonate any person or business, or misrepresent your affiliation with any entity
- Use automated scripts, bots, or scrapers to collect information from the Site without our written permission
- Attempt to access any account, system, or data not intended for you
- Interfere with the proper functioning of the Site (including through denial-of-service attacks, malware, or similar activities)
- Use EPFoodies to send spam, unsolicited commercial messages, or promotional content unrelated to our community
- Violate any applicable local, state, federal, or international law
6. Intellectual Property
All content on EPFoodies that is created by us โ including the website design, logo, written reviews, photographs, newsletter content, and code โ is owned by EPFoodies / SC Studios and protected by copyright and other intellectual property laws.
You may view and share links to our content for personal, non-commercial purposes. You may not copy, reproduce, republish, distribute, or create derivative works from our content without our prior written permission.
Content submitted by food truck owners (such as their truck description and schedule) remains their property but is licensed to us as described in Section 4.
7. Restaurant Reviews
Restaurant reviews published on EPFoodies represent the personal opinions and experiences of the author at the time of writing. Menus, prices, hours, and quality may change. EPFoodies makes no warranty that any information in a review remains accurate, and we are not responsible for your experience at any reviewed establishment.
If you are a business owner and believe a review contains factual inaccuracies, please contact us at moises@epfoodies.com and we will review the matter in good faith.
8. Third-Party Links and Services
EPFoodies may contain links to third-party websites, services, or content (including social media platforms, map services, and external restaurant websites). We do not control these third parties and are not responsible for their content, policies, or practices. Accessing third-party sites is at your own risk.
9. Advertising
EPFoodies may display advertisements served by Google AdSense or other ad networks. We do not endorse any advertised product or service and are not responsible for the content of advertisements or any transactions between you and advertisers.
10. Disclaimer of Warranties
EPFoodies is provided “as is” and “as available” without warranty of any kind, express or implied. We do not guarantee that:
- The Site will be uninterrupted, error-free, or secure
- Information on the Site (including food truck schedules, locations, and restaurant details) is accurate, current, or complete at all times
- Any food truck listed on the Site will be at the time or location they’ve submitted
Food truck schedules are submitted by the trucks themselves and may change without notice. Always verify with the truck directly before traveling specifically to visit them.
11. Limitation of Liability
To the fullest extent permitted by law, EPFoodies, SC Studios, and our owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of the Site, including but not limited to:
- Loss of profits, data, goodwill, or other intangible losses
- Bad food experiences or food-related illness
- Missed food trucks (e.g., arriving at a location where the truck was no longer present)
- Disputes between you and any food truck, restaurant, advertiser, or other user
Our total cumulative liability to you for any claim arising out of these Terms or your use of the Site shall not exceed one hundred U.S. dollars ($100.00).
12. Indemnification
You agree to indemnify and hold harmless EPFoodies, SC Studios, and our owners, operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Site, or your violation of any third party’s rights.
13. Termination
We may suspend or terminate your access to EPFoodies at any time, with or without notice, for any reason including (but not limited to) violation of these Terms. You may stop using the Site at any time. Provisions of these Terms that by their nature should survive termination (including Sections 6, 10, 11, 12, 14, and 15) will survive.
14. Governing Law
These Terms are governed by the laws of the State of West Virginia, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or your use of EPFoodies shall be resolved in the state or federal courts located in Berkeley County, West Virginia, and you consent to the personal jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Material changes will be announced on the Site. Your continued use of EPFoodies after changes are posted constitutes your acceptance of the updated Terms.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
